Ohio Adopts Asbestos Claim Criteria

Ohio Governor Robert Taft has signed into law a bill which would set the minimum criteria a plaintiff alleging an asbestos injury must show in order to proceed with the plaintiff's case. The law, which is the first of its kind in the country, requires an asbestos plaintiff to come forward with evidence meeting basic thresholds for the type of asbestos injury alleged within thirty days of filing the complaint. Defendants have 120 days to rebut such evidence. Am. Sub. H.B. No. 292, 125th Gen. Assembly, Reg. Sess. (Ohio 2004) ("H.B. 292").
